IVC filters are small devices with spider-like struts or “legs” inserted into a large vein, called the inferior vena cava, to stop blood clots from traveling to the lungs. The California woman had a Cook Celect IVC filter implanted in October 2014 to resolve blood clot issues, according to the lawsuit recently filed in the U.S. District Court, District of Southern Indiana. In December 2016, the plaintiff discovered the problems she was experiencing were a result of the IVC filter tilting, a problem alleged in many Cook Medical IVC filter lawsuits. IVC filters have come under scrutiny of the U.S. Food and Drug Administration (FDA) which has issued a safety alert about the devices. The FDA said it had received 921 adverse event reports about IVC filters since 2005. The reports involved the filters migrating, filter fragments moving to the heart or lungs, and filters perforating the inferior vena cava. To avoid complications, the FDA recommends removing IVC filters between 29 and 54 days after they are implanted.

U.S. District Judge Richard L. Young, who is presiding over the Cook Medical MDL in Southern Indiana, has selected three IVC filter lawsuits for bellwether trials, according to court documents. Bellwether trials are considered test trials that gives plaintiffs, defendants, and the court an idea of how juries will respond to the evidence. Depending on the outcomes of bellwether trials, the parties may decide to settle pending cases. The first IVC trial, scheduled to begin in October, involves a Florida woman who was implanted with a Cook Celect IVC filter in November 2010. Four months later, doctors attempted to remove the device but could not, the lawsuit said. The woman started experiencing gastrointestinal symptoms, fatigue, diarrhea, vomiting and abdominal pain. It was later discovered that the IVC filter had penetrated her inferior vena cava and migrated into her duodenom.
