Richard W. Schulte To Lead Prosecution of Individual Imprelis Damage Claims Filed by Property Owners Seeking Compensation from DuPont for the Damage Allegedly Done by Imprelis Herbicide.

Wright & Schulte LLC, an experienced law firm representing property owners in Imprelis damage claims, is pleased to announce that Richard W. Schulte, a partner with the Firm, has been named Lead Counsel for Individual Plaintiffs in the federal Imprelis litigation underway in U.S. District Court, Eastern District of Pennsylvania. Mr. Schulte was appointed to this role by the Honorable Gene E.K. Pratter in an Order dated January 15, 2014. (In re Imprelis Herbicide Marketing, Sales Practices and Products Liability Litigation, 2:11-md-02284)

As Lead Counsel for Individual Plaintiffs, Richard W. Schulte will lead the prosecution of individual Imprelis lawsuits filed by property owners seeking compensation from DuPont for damage allegedly done to trees by Imprelis herbicide. According to Judge Pratter’s Order, “Individual Plaintiffs” are those who have opted out of the Imprelis class action lawsuit settlement previously approved by the Court in October 2013, or who have brought claims not otherwise barred by that settlement.

“It is an honor to lead the prosecution of cases for those harmed by DuPont’s herbicide Imprelis. We believe the evidence will show that DuPont knew the risks posed by using this herbicide and chose to put it on the market anyway. The discovery process has begun and we are going to carefully scrutinize DuPont’s prior behavior and are confident that they will be held accountable for the damage they have done.” – Richard W. Schulte

According to court documents, Imprelis herbicide was introduced by DuPont in October 2010 and marketed as a safe and effective way to treat the most common and hard to kill broadleaf weeds present in turf grass without any negative impact on surrounding plants. However, the New York Times reported on July 15, 2011 that Imprelis was “the leading suspect in the deaths of thousands of Norway spruces, eastern white pines and other trees on lawns and golf courses across the country. In August 2011, the U.S. Environmental Protection Agency (EPA) issued a Stop Sale and Removal Order for Imprelis, after the agency investigated hundreds of reports of Imprelis tree death throughout the Northeast and Midwest.

According to court documents, Judge Pratter granted final approval to the Imprelis class action lawsuit in October 2013. Among other things, the accord requires DuPont to compensate tens of thousands of property owners for their dead and damaged trees. The Imprelis settlement also provides for compensation to herbicide applicators for costs they incurred while investigating Imprelis damage.

Wright & Schulte LLC is representing hundreds of plaintiffs in Imprelis lawsuits who have opted out of the class action lawsuit, and are pursing individual claims against DuPont. The Firm continues to offer free legal evaluations to property owners seeking to file an individual Imprelis lawsuit. To learn more, please visit, or call 1-800-399-0795.
