Heater-Cooler Lawsuits Allege That Patients Allegedly Contracted NTM Infections When A Sorin 3T Device Was Used During Surgery.
Heater-Cooler Lawsuits are mounting in courts nationwide over its Sorin 3T heater-cooler medical device. The complaints were filed against LivaNova (formerly Sorin Group Deutschland GmbH), are being filed on behalf of patients who allege they were exposed to nontuberculous mycobacterium (NTM), specifically Mycobacterium chimaera (M. chimaera) bacteria when a contaminated heater-cooler device was used during surgery.
Court documents indicate a Sorin Heater-Cooler Lawsuit was filed against LivaNova on behalf of two Pennsylvania men who said they were exposed to NTM through a Sorin 3T heater-cooler device during surgery at the Wellspan York Hospital in York, Pennsylvania. According to the complaint, one man had a quadruple bypass surgery in March 2015, and the other plaintiff had triple bypass surgery also in March 2015. However, the plaintiffs want to make the complaint a potential class-lawsuit on behalf of 3,600 patients who had procedures at York Hospital and at Penn State Milton S. Hershey Medical Center, also in Pennsylvania. York Hospital confirmed 12 cases of NTM infection, six of the patients have died.

Heater-cooler devices are used during cardiothoracic (heart, lung, chest) surgeries to keep patients warm or cool. The devices include tanks that provide temperature-controlled water to external heat exchangers or warming-cooling blankets through closed circuits. Patients do not come into direct contact with water in the circuit.
According to the U.S. Food and Drug Administration (FDA), contaminated water can potentially enter parts of the device or transmit airborne bacteria through the device’s exhaust vent into the environment and to the patient.
Court documents show a Sorin 3T heater-cooler infection lawsuit was filed on behalf of a South Carolina man who said he underwent a coronary artery bypass grafting procedure in March 2014 and allegedly contracted the m. abscessus infection. (Heater-Cooler Lawsuit Case No.6:16-cv-03129, U.S. District Court, District of South Carolina) Another complaint was filed on behalf of an Iowa man who underwent a heart valve replacement in October 2012 and was diagnosed two years later with disseminated M.Chimaera. Despite extensive medical treatment, the plaintiff died in May 2014 due to Disseminated Mycobacterium Avium Intracellular Complex infection, according to the complaint.
