Lumber Liquidators Class Action Lawsuits Name National Flooring Chain as Purportedly Selling Chinese-Manufactured Laminate Flooring Contiaining Unsafe Levels of Formaldehyde

Lumber-Liquidators-Contaminated-FlooringWright & Schulte LLC is monitoring with interest the growing number of Lumber Liquidators class action lawsuits that are currently pending in courts around the U.S., all of which allege the company sold Chinese-manufactured laminate flooring that contained unsafe levels of formaldehyde, a chemical known to cause respiratory ailments and cancer. According to a report that recently aired on 60 Minutes, tests of the flooring conducted on behalf of plaintiffs in Lumber Liquidators lawsuits found that some samples of the laminate contained significantly more formaldehyde than the state of California currently allows. California’s limits on formaldehyde will become the national standard next year, according to 60 Minutes.

“This is an extremely serious issue, as long-term exposure to formaldehyde increases the risk for serious respiratory problems. The chemical has also been linked to certain cancers, including leukemia. We are pleased to see that litigation involving Lumber liquidators is growing, as such lawsuits may be the only way consumers affected by the company’s allegedly defective flooring can obtain compensation for the losses they may have incurred,” says Wright & Schulte LLC. The firm is currently representing consumers nationwide in product liability lawsuits involving allegedly defective products. According to one Lumber Liquidators class action lawsuit currently pending in California’s Alameda Superior Court California, the retailer’s website promises that all of its flooring comes from mills certified as compliant with California’s formaldehyde standards. However, the complaint alleges that testing showed average initial formaldehyde exposures over 100 times above the amount allowed to be sold without a warning label under state law. “Without exception, the Lumber Liquidators products produced in China that Plaintiffs tested emitted formaldehyde at far higher rates than those manufactured in Europe or North America – on average, Chinese products emitted at 350% the rate of European/North American products,” the complaint states. (Case No. RG14733979)

According to Wright & Schulte LLC, consumers who have this flooring installed in their homes may be entitled to compensation for the laminate’s initial installation, the cost to replace the flooring, loss of use of the home, remediation costs, diminished property values, and more.
