GranuFlo Lawsuit Alleges Fresenius Medical Care Promoted Their Kidney Dialysis As Safe And Billed The State’s Medicaid Program For The Product.

The Kentucky Attorney General Andy Beshear contends that Fresenius promoted GranuFlo as safe but ignored the health risks and potential death associated with it. Bashear’s allegations mirror those in 4,350 GranuFlo lawsuits pending in the U.S. District Court, District of Massachusetts that contend dialysis patients suffered heart attacks, strokes, cardiac arrest or sudden cardiac death after they were given GranuFlo or NaturaLyte concentrates during dialysis. The Attorney General claims that Fresenius conducted a clinical study of 667 of its dialysis facilities and found that 941 patients had cardiopulmonary arrests. However, the company did not clearly disclose that Granuflo could cause high bicarbonate levels in patients that could result in adverse cardiac events. Beshear said Fresenius, which has more than 50 clinics in Kentucky, billed Kentucky’s Medicaid program for $16 million related to the use of and treatment associated with GranuFlo. Kentucky’s complaint seeks a refund since Fresenius allegedly committed Medicaid fraud for “using a known harmful product in its dialysis machines around patients and employees.” The lawsuit was filed September 1 in Franklin County Circuit Court.

GranuFlo and NaturaLyte are dialysis concentrates used to treat acute and chronic renal failure during the hemodialysis procedure, according to the U.S. Food and Drug Administration (FDA). Inappropriate use of the products can cause dialysis patients to have metabolic alkalosis, a high serum bicarbonate level that can lead to heart attack, stroke, cardiac arrest, dangerously low blood pressure or sudden cardiac death, the FDA said.

In November 2011, Fresenius sent a memo to its own dialysis clinics warning doctors that improper use of GranuFlo and NaturaLyte appeared to be a factor in patients dying suddenly from cardiac arrest, according to a New York Times report. The FDA questioned the company after learning about the memo. Afterward, Fresenius contacted dialysis clinics that it did not own about the concerns. In June 2012, the FDA issued a Class I recall notice (the most serious type of recall the FDA issues) for NaturaLyte Liquid Acid Concentrate and NaturaLyte GranuFlo (powder) Acid Concentrate.

Court documents indicate that Attorney Generals in Louisiana and Mississippi filed similar GranuFlo lawsuits in 2014 against Fresenius Medical Care. The Attorney Generals accused Fresenius of unfair and deceptive practices by misrepresenting GranuFlo and NaturaLyte as being safe to administer to dialysis patients yet failing to disclose the products’ potential of causing cardiovascular events including sudden cardiac death.
