Xarelto Bleeding Lawsuits Allege The Blood Thinner Causes Significant Bleeding Events And Bayer Healthcare And Janssen Pharmaceuticals Inc. Failed To Disclose The Bleeding Risk Associated With Xarelto.

The lawsuits filed against Bayer Healthcare and Janssen Pharmaceuticals Inc., the makers of the blood thinner, allege Xarelto uncontrollable bleeding, hemorrhaging and other Xarelto side-effects. Claims also state there is no Xarelto antidote or reversal agent to stop the uncontrolled bleeding. There are currently over 1600 Xarelto bleeding lawsuits consolidated in the U.S. District Court of Eastern District of Louisiana.

U.S. District Judge Eldon Fallon issued a Case Management Order (CMO) on September 18th regarding the trial dates and instructions for plaintiffs’ and defendants’ attorneys. The first two trials are scheduled for February 6, 2017, and March 13, 2017, in the Eastern District of Louisiana in New Orleans. Judge Fallon said he is open to having attorneys ask for the first trial to be moved to March if they determine the trial cannot be concluded before Mardi Gras begins later in the month. The third trial will be on April 24, 2017 in Mississippi and the fourth trial will be held on May 30, 2017 in Texas, at federal district courts yet to be determined. Xarelto (rivaroxaban) is an anti-clotting medication approved by the U.S. Food and Drug Administration (FDA) to prevent deep vein thrombosis in patients undergoing knee or hip replacement surgery, to prevent stroke in patients with atrial fibrillation not caused by a heart valve problem, and to reduce the risk of blood clots. The medication is manufactured and marketed by Bayer HealthCare and Janssen Pharmaceuticals Inc. Court documents indicate that 40 cases will be selected by January 2016 for inclusion in the initial bellwether pool of cases. In his Case Management Order, Judge Fallon directed the parties to select 10 cases each and the court will randomly select 20 cases. The cases will then go through discovery, which includes depositions. By August 1, 2016, the parties will propose specific cases for trial, according to the CMO. The cases pending in the Xarelto MDL all allege that the defendants failed to warn doctors about the serious and fatal bleeding risks associated with Xarelto and the blood thinner has no specific antidote or reversal agent to stop uncontrollable bleeding occurring in patients taking Xarelto.
