Federal IVC filter lawsuits alleging injuries from the inferior vena cava devices have now risen to a combined 2,500 complaints. The IVC filter is made by C.R. Bard Inc. and Cook Medical Inc. IVC filter lawsuits filed against C.R. Bard over its Recovery and G2 IVC filters are pending in a multidistrict litigation (MDL) in the U.S. District Court, District of Arizona. The number of IVC filter injury lawsuits saw a 15 percent increase, from 1,112 as of November 15, to 1,283 as of December 15, according to the U.S. Judicial Panel on Multidistrict Litigation’s (JPML) MDL statistics report. The number of IVC filter injury complaints rose from 1,176 to 1,225, from November 15 to December 15, the JPML’s statistics report showed.

Inferior Vena Cava (IVC) filters are small cage-like devices implanted in the inferior vena cava, a large vein that carries blood from the lower part of the body to the heart. IVC filters are used to capture blood clots to prevent them from traveling to the lungs. Some IVC filters are retrievable which means they can be removed after patients are no longer at risk for blood clots.
The U.S. Food and Drug Administration (FDA) has issued two safety alerts advising doctors to remove IVC filters between 29 and 54 days after implantation or when the risk of blood clots subside. Otherwise, patients may suffer serious complications. For instance, the FDA said it has received nearly 1,000 adverse events reports between 2005 and 2010 of IVC filters migrating, fracturing, and perforating the heart, lungs and inferior vena cava.
Court documents indicate that one of the cases transferred into the Cook Medical MDL was filed on behalf of a Texas man who was implanted with a Celect IVC filter in December 2009. In September 2015, the plaintiff underwent an imaging study that showed his IVC filter had perforated his inferior vena cava, aorta and spine. The plaintiff claims he is now at risk for further injuries, including the risk of death, from the Cook Celect filter and will require ongoing medical monitoring for the rest of his life.
