DuPont Ordered To Pay $2 Million In C8 Lawsuit After Ohio Man Developed Testicular Cancer

C8 Lawsuit Jury Found DuPont Was Negligent In Allowing Its Washington Works Plant To Release The C8 Chemical Into The Ohio River.

This is the third trial DuPont has lost involving its Washington Works Plant near Parkersburg, West Virginia releasing the C8 chemical into the Ohio River for decades without notifying Mid-Ohio Valley residents. DuPont is facing 3,500 lawsuits that assert Ohio and West Virginia plaintiffs developed testicular cancer, kidney cancer, thyroid disease and other health disorders after drinking water tainted with the C8 chemical used at the plant to make Teflon.

Jurors began deliberating on Monday and delivered the verdict on Wednesday after a four-week trial in the federal courthouse in Columbus, Ohio. In addition to awarding compensatory damages, the jury also found DuPont was negligent and its conduct was malicious, the Columbus Dispatch reported. The malicious conduct finding allows the jury to consider punitive damages. The punitive damages phase of the trial is scheduled for January 4. The Washington County man, now 56, said he was diagnosed with testicular cancer in 1997 after drinking water supplied by the City of Belpre, and the Little Hocking Water Association, two of six water districts in Ohio and West Virginia affected by the C8 contamination.

DuPont’s Washington Works plant had been using perfluorooctoanoic acid, also known as C8, to manufacture Teflon and other non-stick coatings. In 2001, a class-action complaint was filed against DuPont on behalf of nearly 70,000 Ohio and West Virginia residents who were exposed to C8 contaminated water. The complaint was settled in 2005 and part of the settlement included creating a C8 Science Panel to conduct a study to determine whether there was a probable link to C8 and the diseases community members were suffering. In 2012, the three-member panel of epidemiologists found a probable link between C8 and:

• High cholesterol
• Kidney cancer
• Pregnancy induced hypertension (pre-eclampsia)
• Testicular cancer
• Thyroid disease
• Ulcerative colitis

Residents, former residents, their survivors, or anyone else who consumed water in one of six water districts in Ohio and West Virginia affected by the C8 contamination and who developed one of these six health disorders during the time period specified by the DuPont C8 class-action lawsuit settlement could file a lawsuit against DuPont.

Court documents indicate that Wednesday’s jury verdict was the second highest since C8 bellwether trials began last year. In July, an Ohio man who said he developed testicular cancer due to exposure to C8 was awarded $5.1 million and the jury ordered DuPont to pay $500,000 in punitive damages. In October 2015, another jury ordered DuPont to pay $1.6 million to an Ohio woman who said she developed kidney cancer from her exposure to C8. More trials involving C8 cancer lawsuits are scheduled for next year. DuPont is facing 10 C8 cancer trials to run from May 1, 2017 to July 31, 2017. (In Re: E.I.
