The DePuy Pinnacle Hip Replacement Lawsuit (Case No. 3:13-cv-02005-K) is part of MDL 2244 and was filed on May 28, 2013 in U.S. District Court of the Northern District of Texas, Dallas Division. This case joins more than 3,300 other Pinnacle lawsuits that have already been filed against DePuy. According to the allegations in the complaint, DePuy did not conduct sufficient safety testing on the Pinnacle Hip system’s metal-on-metal design, and the manufacturer intentionally failed to warn the public about the high risk of system failure even after receiving hundreds of patient reports regarding Pinnacle Hip defects. Despite such reports of Pinnacle Hip failures, the complaint points out that DePuy has continued to sell its defective hip implant without any warnings.

Court documents explain that the plaintiff had the DePuy Pinnacle System implanted in his right and left hips in September and November 2006, respectively. Shortly after implantation, however, the plaintiff began experiencing painful complications that included hip tenderness and problems walking. As a direct result of these severe complications, in 2012, the plaintiff sought medical attention, at which time he was informed that he had an elevated level of metal ions in his blood (a condition known as metallosis). Due to the unrelenting pain associated with his hip implant complications, in December 2012, the plaintiff underwent risky revision surgery to remove and replace the failed DePuy Pinnacle Hip implant in his left hip. Additionally, he is scheduled to undergo another revision surgery to remove and replace the DePuy Pinnale System in his right hip sometime in 2013.
DePuy Announces Metal-On-Metal Hip System Phase Out
In May 2013, DePuy Orthopaedics, Inc. announced that it will slowly be phasing out the production and sale of its all-metal Pinnacle hip implant devices and that the Pinnacle will not be available in the U.S. as of August 2013. The DePuy Pinnacle is the company’s last remaining metal-on-metal (MoM) hip implant device on the market, as DePuy recalled its all-metal ASR hip implant device in 2010 due to reports alleging that the DePuy ASR Hip Replacement had a 40% rate of early failure. As stated in the New York Times, according to DePuy, a phase out of the Pinnacle hip system was spurred primarily by a January 2013 FDA ruling requiring that manufacturers of metal-on-metal hip implants prove through additional clinical studies that Metal-on-Metal Hip implants are safe and effective before continuing to sell them in the U.S. This FDA ruling intended to close an existing loophole which had allowed manufacturers to only show their devices are similar to those currently available in the U.S. without having to conduct clinical testing prior selling them. “DePuy has communicated to the F.D.A. its decision not to pursue further clinical studies on the Pinnacle,” DePuy officials expressed in a recent statement.
