Depuy Pinnacle Hip Lawsuits Pending In Multidistrict Litigation Allege That DePuy’s Metal-On-Metal Hip Implant Fails Prematurely And Causes Pain, Metal Poisoning And Other Complications In The Hip Implant Recipient.

According to court documents, U.S. District Judge Ed Kinkeade selected 10 potential bellwether cases from the multidistrict litigation (MDL) established for metal-on-metal Pinnacle Hip lawsuits in the U.S. District Court, Northern District of Texas. Judge Kinkeade’s order shows that while he has determined potential bellwether selections, he has not yet scheduled trial dates. The order further states that a stay in proceedings for the Pinnacle Hip MDL 2244 will remain until the bellwether trials are completed. Court documents show there are 7,147 Pinnacle Hip complaints pending in the MDL as of March 16. The lawsuits are filed on behalf of recipients of DePuy’s Pinnacle Hip system who allege that their all-metal hip implant prematurely fails and causes metal poisoning, chronic pain, bone loss, blood poisoning, infection, and other complications. The Pinnacle hip complaints further allege that the artificial hip system is defectively designed and forces recipients to undergo revision surgery to remove the metal hip device. The U.S. Food and Drug Administration (FDA) explains that metal-on-metal hip replacement systems have a metal femoral head or ball, that rotates within a metal cup. The FDA further explains that some of the metal debris that rubs off from the implant will enter an implant recipient’s bloodstream and cause damage to bone or tissue surrounding the implant and joint. According to the DePuy lawsuits, the Pinnacle Hip is different in that its cup uses a metal acetabular liner. By using this metal liner and a metal femoral ball, the Pinnacle Hip forces metal to rub against metal with the full weight and pressure of the human body, and this causes the implants to fail, according to the Pinnacle Hip lawsuits. In January 2013, the FDA announced proposed changes in the regulation of all-metal hip implant devices. The FDA proposed that manufacturers of hip replacement systems go through the federal agency’s rigorous process for evaluating the safety and effectiveness of high risk medical devices. After the FDA made its announcement, Bloomberg reported that Johnson & Johnson stopped selling its all-metal hip implants because sales in the United States and Europe had declined since 2007 after doctors began questioning the safety of the hip implants and patients began filing lawsuits over the hip devices.
