LivaNova PLC and its subsidiaries have asked a federal judicial panel to deny a request to consolidate a motion to consolidate 15 3T Heater-Cooler lawsuits. The lawsuits all allege the heating and cooling machine used in cardiothoracic surgery cause life-threatening infections in some cardiac surgery patients when they are exposed to Nontuberculous Mycobacteria (NTM) infections, namely M. chimaera, due to heater-cooler units. Patients claim they now suffer fevers, surgical wound infections, joint and muscle pain, weight loss, fatigue and other complications, including death. Plaintiffs and defendants will argue their positions before the U.S. Judicial Panel on Multdistrict Litigation (JPML) on March 30 at the federal district court in Phoenix, Arizona.

Wright & Schulte LLC, which represents clients in defective medical device cases, notes that thousands of patients have been notified by hospitals about their potential exposure to NTM infections during surgery involving the heart, liver or lungs. Since more Sorin 3T lawsuits are expected to be filed, plaintiffs involved in pending lawsuits have asked the JPML to transfer all existing and future complaints to the U.S. District Court, District of South Carolina for coordinated pretrial proceedings. The Sorin 3T Heater-Cooler devices are used to regulate a patient’s blood temperature during cardiothoracic surgery. The machines have tanks that provide temperature-controlled water to external heat exchangers or to warming-cooling blankets through closed units. The water in the tank does not come in contact with the patient. However, there is a potential for contaminated water to enter other parts of the unit or transmit airborne bacteria through the exhaust vent into the environment and to the patient. According to the U.S. Food and Drug Administration, NTM organisms can be found in soil and water, including tap water sources, and typically are not harmful. However, the organisms may cause infections in patients who are very ill or in people who have weakened immune systems.

Sorin 3T Heater-Cooler lawsuits allege patients with NTM infections first develop symptoms including joint pain, fatigue, night sweats, fevers, weight loss, heat or pus, around the surgical wound. A lawsuit recently filed in the Central Illinois federal court stated an Illinois man began having problems with balance, night sweats, intermittent fevers, and extreme fatigue shortly after having a coronary artery bypass grafting procedure in February 2015. A Sorin 3T Heater-Cooler device was used during the surgery. The complaint stated he had a sternal wound infection, and was placed on antibiotics and fitted with a wound vac. He is currently seeing an infectious disease specialist. The lawsuit contends the defective 3T Heater-Cooler unit placed the plaintiff at risk for harm and injury
