Nexium Lawsuits Allege Proton Pump Inhibitor Medications That Treat Heartburn And Acid Reflux Cause Kidney Failure, Renal Failure And Other Injuries.

In October, the U.S. Judicial Panel on Multidistrict Litigation (JPML) asked all defendants to respond to the plaintiffs’ consolidation request. AstraZeneca, which makes Nexium and is a defendant in all but one lawsuit, argues that the issues are too broad because of the different prescription and over-the-counter (OTC) medications involved. Consolidation, the company said in its brief, would create “unwieldy” litigation “with a hodge-podge of divergent defendants, medications (prescription and OTC), and alleged injuries.” Procter & Gamble said it is only named in one lawsuit and its OTC Prilosec is “substantially different” than the other prescription products. Pfizer Inc., had similar objections, saying it sells only OTC PPI formulations and is named as a co-defendant in only one lawsuit. Takeda Pharmaceuticals U.S.A., Inc., which markets Prevacid and Dexilant, said centralization is premature and the cases do not have common factual issues as plaintiffs claim. Nexium, also known as “the purple pill,” is in a class of drugs called Proton Pump Inhibitors (PPI) that treat digestive disorders and ulcers by reducing the amount of acid in the stomach. PPIs, such as Zegerid, Prevacid and Prilosec are available by prescription and OTC. In its motion to the JPML, AstraZeneca said it “pioneered” Prilosec, the first prescription-only medication in the class, and approved by the FDA in 1989, followed by Nexium, which the FDA approved in 2001. Court records indicate that one of the Nexium side-effects lawsuits included in the plaintiffs consolidation request involves a Missouri resident who took Nexium and other PPIs from 2010 to 2016. The Nexium complaint alleges that the plaintiff suffered kidney injuries, including chronic kidney disease, in 2010.
