Plaintiff In C8 Lawsuit Trial Testifies He Developed Testicular Cancer After Exposure To Contaminated Water

The Fourth C8 Lawsuit Trial Continues With Accusations DuPont’s Washington Works Plant Emitting C8 Into The Ohio River, Contaminating The Local Water Supply.

The 56-year-old plaintiff developed testicular cancer allegedly after exposure to C8 contaminated drinking water. He recalled how he moved to a suburb of Marietta, a southeast Ohio city in the 1990s, and his suburban Cutler home’s water was supplied by the Little Hocking Water Association. The water association used wells across the Ohio River from DuPont’s Washington Works plant in Parkersburg, West Virginia. The C8 lawsuit alleges DuPont’s Washington Works plant released the toxic C8 chemical contaminating the well fields and his exposure to the C8-tainted water caused him to develop testicular cancer.

C8 Lawsuits

The trial for the plaintiff’s C8 lawsuit is underway in the U.S. District Court of Columbus where 3,500 C8 lawsuits are pending against the company. (Case No. 2:13-cv-01103, C-8 Personal Injury Litigation, MDL No. 2433). The men and women who filed the C8 lawsuits contend that they developed testicular cancer, kidney cancer, and other medical orders after exposure to contaminated drinking water. The drinking water was found to have perfluorooctanoic acid, or C8 for short, believed to be released from DuPont’s plant. The plaintiff testified that he was diagnosed in 2000 with cancer of the right testicle. In testifying about the emotional impact of his diagnosis, the plaintiff told jurors, “You hear ‘Blah, blah, blah, cancer. Blah, blah, blah, cancer.’ The rest is white noise,” according to a Columbus Dispatch report on the trial, which is expected to continue today.

C8 Class-Action and The C8 Science Panel

In 2001, a class-action lawsuit was filed against DuPont on behalf of nearly 70,000 Ohio and West Virginia residents who lived or worked near its Washington Works Plant. (Leach v. E.I. Du Pont De Nemours & Co., No. 01-C-608 (W. Va. Cir. Ct.))

As part of the class-action lawsuit settlement in 2005, a C8 Science Panel was established to determine whether there were probable links between exposure to C8 and diseases in the community. The science panel reported probable links between C8 and:

• High cholesterol
• Thyroid disease
• Testicular cancer
• Kidney canter
• Ulcerative colitis
• Pregnancy induced hypertension (pre-eclampsia)

Water Districted Affected By C8 Water Contamination

Those who developed the health disorders were eligible to sue DuPont if they lived or worked in one of six water districts for at least one year prior to December 3, 2004. The water districts are:

• City of Belpre, Ohio
• Little Hocking Water District
• Lubeck Public Service District, West Virginia
• Mason County Public Service District, West Virginia
• Tuppers Plains, Ohio
• Village of Pomeroy, Ohio

The Little Hocking Water Association sued DuPont in 2009 for allegedly contaminating its well fields with the C8 chemical. The case was settled for an undisclosed amount in November. DuPont also settled a test case before it went to trial in March. The company, however, lost a C8 trial in October when the jury awarded $1.6 million to a Guysville, Ohio woman who said she developed kidney cancer from drinking C8-tainted water.
