Jury Expected To Begin Deliberations In C8 Lawsuit Trail Involving Ohio Man Who Developed Testicular Cancer After Exposure To C8 Contaminated Drinking Water
C8 Lawsuit Trial News: The current C8 lawsuit trial is entering it’s fourth week after a retired occupational health coordinator took the stand for DuPont. The former health coordinator for DuPont testified that he never believed the C8 chemical released from the plant would harm anyone. The C8 lawsuit was filed by a 56 year old man from Cutler, Ohio, a suburb of Marietta, who developed testicular cancer after exposure to the contaminated water. The jury hearing the C8 lawsuit is expected to begin deliberations this week.

DuPont’s Washington Works plant used perfluorooctanoic acid, better known as C8, to produce Teflon used on non-stick cookware. The protective finishes are also used on carpets and water-resistant clothing. In 2001, a C8 class-action lawsuit was filed against DuPont. The lawsuit was filed on behalf of nearly 70,000 Ohio and West Virginia individuals who either lived or worked near the company’s plant and were exposed to C8-tainted drinking water. (Leach v. E.I. C8 Science Panel
The C8 class-action complaint was settled in 2005. The settlement called for the creation of a C8 Science Panel to determine whether there were probable links between C8 and diseases in the community.The findings released by the panel in October 2012 showed a probable link between C8 exposure and:
• High Cholesterol
• Kidney Cancer
• Pregnancy-Induced Hypertension (pre-eclampsia)
• Testicular Cancer
• Thyroid Disease
• Ulcerative Colitis (inflammatory bowel disease)
The C8 lawsuit trial currently underway in the U.S. District Court, District of Southern Ohio, is considered a bellwether or “test” trial and the outcome will help plaintiffs, defendants and the court determine how to resolve the pending C8 cases against DuPont. In a test trial that ended in October, the federal court jury awarded $1.6 million to a Guysville, Ohio woman who said she developed kidney cancer from drinking C8-tainted water. DuPont has decided to appeal the jury verdict. (Case No. 2:13-cv-00479) Another bellwether C8 case was scheduled for trial in March, but DuPont settled with the plaintiff for an undisclosed amount before the trial started.
