The personal injury and wrongful death claims allege plaintiffs developed testicular cancer, kidney cancer, thyroid disease and other health disorders from drinking water contaminated by the C8 released from DuPont’s plant near Parkersburg, West Virginia. The plaintiff, now 56, alleges he developed testicular cancer in 1997 after drinking C8-tainted water from the Little Hocking Water Association, one of six water districts in Ohio and West Virginia affected by the C8 contamination. Little Hocking accused DuPont’s Washington Works of contaminating its 45 acres of wells located across the Ohio River from the plant. Little Hocking, which supplies water to schools, businesses and about 12,000 residents in the Southeast Ohio counties of Washington and Athens, filed a C8 lawsuit against DuPont in 2009. The case was settled for an undisclosed amount in 2015. During the trial last week, jurors heard how smoke from the plant’s stack blew C8 particles onto the well fields and got into the water, according to The Columbus Dispatch.

“It is important for jurors to hear how the public and private drinking water supply were contaminated by C8 and then consumed in residences and businesses,” says Richard Schulte, a founding partner of Wright & Schulte and a member of the Plaintiffs’ Steering Committee for the C8 lawsuit litigation. Plaintiffs in C8 lawsuits allege that DuPont’s Washington Works plant had been discharging C8, also known as perfluorooctoanoic acid, for decades into the Ohio River. The chemical was being used to manufacturer Teflon and other non-stick coatings. In 2001, a class-action lawsuit was filed against DuPont on behalf of nearly 70,000 Ohio and West Virginia residents who had ingested the C8-tainted water. As part of the 2005 settlement of the class-action complaint, a study would be conducted to determine whether there was a probable link to C8 exposure and diseases reported in the community. In 2012, a C8 Science panel of three epidemiologists found a probable link between C8 and:

• High cholesterol
• Kidney cancer
• Pregnancy induced hypertension (pre-eclampsia)
• Testicular cancer
• Thyroid disease
• Ulcerative colitis

Residents, former residents, their survivors, or anyone else who consumed water in one of six water districts in Ohio and West Virginia affected by the C8 contamination and who developed one of these health disorders during the time period specified by the DuPont C8 class-action lawsuit settlement could file a lawsuit against DuPont.

According to court documents, 10 more C8 cancer trials are scheduled from May 1, 2017 to July 31, 2017. Additionally, two C8 bellwether trials have already been held. In October 2015, a jury ordered DuPont to pay $1.6 million to an Ohio woman who developed kidney cancer.
