Wright & Schulte LLC Is Investigating IVC Filter Lawsuits Alleging Cook Medical’s IVC Filters Break, Tilt, Migrate, And Perforate The Inferior Vena Cava And Cause Death.

The federal judge presiding over Cook Medical’s IVC filter lawsuit claims has expanded the number of potential cases to be selected for bellwether trials. U.S. District Judge Richard L. Young said that adding 10 cases to the discovery pool is necessary due to the rapid growth of the litigation. The Inferior Vena Cava (IVC) filter lawsuits allege Cook Medical failed to warn that its Celect IVC filters and Günther Tulip IVC filters fracture, migrate, tilt and puncture the heart, lungs, and the vena cava.

Ten IVC filter lawsuit cases were selected for bellwether trials last year. However, in an amended Case Management Order (CMO) issued on April 18, Judge Young said the Cook IVC multidistrict litigation (MDL) rose from 75 cases to nearly 350. Therefore, a larger pool of cases is needed to reflect the growth of the MDL. Judge Young directed plaintiffs and the defendant to each select 10 cases by April 29, for a total of 20 cases. The cases may include any of the five cases each side already selected. The parties are to exchange lists and strike cases until seven cases for each side are left by May 13. From the 14 total cases, each side is to select three cases. From the six cases, Judge Young will select at least three cases for bellwether trials, according to the CMO. IVC filters are small devices implants in the inferior vena cava, a major vein that carries from to the heart from the lower part of the body. The device’s struts form what resembles a cage to trap blood clots to prevent them from reaching the lungs and causing a pulmonary embolism, which can be fatal.

The U.S. Food and Drug Administration (FDA) issued two warnings about IVC filters since 2010. The agency said it has received adverse events reports since 2007 about the devices migrating, tilting, breaking and puncturing the vena cava, heart and other organs. The agency suggested the problems with IVC filters are due to the devices staying implanted longer than necessary. The FDA recommends doctors remove IVC filters between 29 and 52 days after they are implanted or as soon as there is no longer a threat of a pulmonary embolism.

Court documents show that the IVC lawsuit filters against Cook Medical have been consolidated in the U.S. District Court, Southern District of Indiana for coordinated pretrial proceedings. Judge Young has previously scheduled the first bellwether trial no earlier than September 15, 2016. According to Judge Young’s CMO, the purpose of bellwether trials is to help resolve a MDL by testing the claims and defenses presented in the cases.
