Eleven More C8 lawsuits filed in Athens County Join The More Than 75 Cases Currently Pending Against DuPont in Federal C8 Litigation.
The personal injury lawyers at Wright & Schulte LLC report on the mounting number of C8 lawsuits against Dupont as they have recently learned of 11 new cases filed in Athens County, Ohio. All of the personal injury complaint have joined the ongoing C8 federal litigation currently underway in the U.S District Court, Southern District of Ohio, MDL No. 2433. These 11 new complaints bring the total number of C8 lawsuits filed against DuPont to more than 75, with the first cases scheduled to proceed to trial in the fall of 2015.(In Re: E.I. DuPont De Nemours and Company C-8 Personal Injury Litigation, MDL No. 2433)
The complaints for these lawsuits all generally allege that the plaintiffs were exposed to C8 tainted drinking water associated with DuPont’s Washington Works Plant in Parkersburg, West Virginia. C8 is a chemical used in the production of Teflon at this plant, and it has been reportedly linked to the development of serious health complications. Specifically, some of the severe health problems that the plaintiffs in these C8 lawsuits have allegedly developed as a result of being exposed to contaminated drinking water have reportedly included kidney cancer, testicular cancer, thyroid disease, inflammatory bowel disease (ulcerative colitis), preeclampsia (high blood pressure during pregnancy) and high cholesterol.
Wright & Schulte LLC is currently representing numerous plaintiffs who have filed personal injury and wrongful death lawsuits against DuPont in the C8 federal litigation. Firm partner, Richard W. Schulte, is serving on the Plaintiffs’ Steering Committee in these proceeding. Mr. Schulte was appointed to the Committee by Judge Edmund A. Sargus, Jr. in an Order dated May 29, 2013.
C8 Lawsuit Settlement
C8, also known as perfluorooctoanoic acid (PFOA), had been used for decades at DuPont’s Washington Works plant. In 2005, DuPont reached a settlement in a C8 class action lawsuit. One of the stipulations required was to establish a scientific panel to explore the health consequences of C8 exposure. The settlement also preserved the rights of class members living in any of the six affected water districts near the Plant the ability to sue for personal injuries in the event the C8 Science Panel established a probable link between C8 exposure with any illness or disorder. The six water districts affected by the DuPont C8 class action lawsuit included:
•Little Hocking, Ohio
•Village of Pomeroy, Ohio
•Tuppers Plains, Ohio
•Lubeck Public Service District, West Virginia
•Mason County Public Service District, West Virginia
(Leach v. E.I. Du Pont De Nemours & Co., No. 01-C-608 (W. Va. Cir. Ct.))
C8 Contamination and Exposure
According to Wright & Schulte, the effects of C8 exposure have been plaguing people in the vicinity of the DuPont Washington Works Plan in West Virginia for years. In September 2012, the Science Panel concluded that there were probable links between the exposure to C8 contaminated drinking water and several illnesses, including:
• Kidney Cancer
• Testicular Cancer
• Thyroid Disease
• Inflammatory Bowel Disease (Ulcerative Colitis)
• High Cholesterol
