Plaintiffs In C8 Lawsuits See Justice With $671 Million Settlement After Developing Testicular and Kidney Cancer From Dumping of C8 Into The Ohio River

The settlement comes during the fourth C8 lawsuit trial and after jurors in three previous C8 lawsuit trials found in favor of the plaintiffs and awarded damages to men and women who developed testicular cancer and kidney cancer. Both DuPont and Chemours, the company that now owns the plant, have each agreed to pay $335.35 million in cash to settle the 3,500 C8 lawsuits pending in the U.S. District Court, District of Southern Ohio. The lawsuits allege DuPont dumped C8, a cancer-causing chemical, from its Washington Works Plant in Parkersburg West Virginia into the Ohio River. The Teflon ingredient, or perfluorooctoanoic acid (PFOA) evidently contaminated public and private drinking water causing cancer clusters in six Ohio water districts.

DuPont has previously agreed to pay $350 million for a water filtration system in the affected water communities, the collection of health information and health studies in the affected areas. In addition to the C8 lawsuit cash settlement and DuPont’s commitment to help clean and monitor the water, a statement announced Chemours has agreed to pay the first of $25 million of any potential future PFOA costs. This is in addition to the settlement and will be paid annually over the next five years. The statement further went on to say DuPont will also cover additional costs up to $25 million.
The first three C8 lawsuit bellwether trials resulted in jurors finding against DuPont and for the plaintiffs. In December, jurors in the third trial awarded the second highest in bellwether trials awarding $1 million to an Ohio man who stated he developed testicular cancer after being exposed to C8-contaminated water. Last July, another Ohio man who also developed testicular cancer was awarded $5.1 million and $500,000 in punitive damages. In October of 2015, a jury awarded $1.6 million to an Ohio woman who developed kidney cancer from exposure to the C8 chemical. (In Re: E.I. The current multidistrict litigation stemmed from the settlement of a 2001 class-action complaint filed on behalf of nearly 70,000 Ohio and West Virginia residents who were exposed to the C8 tainted water. The class-action complaint alleged that DuPont’s Washington Works plant had been using C8 to make Teflon and other non-stick coatings. The lawsuit was settled in 2005 and among the settlement terms was to create a C8 Science Panel to conduct a study to determine whether there was a probable link to C8 and the diseases in the community. In 2012, the three-member panel of epidemiologists found a probable link between C8 and:
• High cholesterol
• Kidney cancer
• Pregnancy induced hypertension (pre-eclampsia)
• Testicular cancer
• Thyroid disease
• Ulcerative colitis
Residents, former residents, their survivors, or anyone else who consumed water in one of six water districts in Ohio and West Virginia affected by the C8 contamination and who developed one of these six health disorders during the time period specified by the DuPont C8 class-action lawsuit settlement could file a lawsuit against DuPont. The six water districts identified by the science panel are:
• Little Hocking, Ohio
• City of Belpre, Ohio
• Tuppers Plains, Ohio
• Village of Pomeroy, Ohio
• Lubeck Public Service District, West Virginia
