Ethicon Vaginal Mesh Lawsuit Claims Allege Women Suffered Permanent Injuries, Such A Vaginal Scarring And Perforated Organs Due To Unsafe Bladder Mesh

After a two-week trial in the Philadelphia Court of Common Pleas, the jury returned its verdict on February 10. According to the complaint, the woman had a TVT pelvic mesh sling implanted in 2005 to treat stress urinary incontinence. Two years later after she began to experience pain, it was determined that the mesh had become exposed. The woman underwent surgery to remove the exposed portion of the mesh. Three years later, the woman underwent another surgery because more mesh became exposed. The jury found Ethicon’s product was defectively designed and not reasonably safe, and the woman’s doctor would not have implanted the device had Ethicon warned about its risk. The jury award included $3.5 million in compensatory damages to the woman, $250,000 to her husband for loss of consortium, and $10 million in punitive damages against Ethicon. Transvaginal mesh is used to repair pelvic organ prolapse through the vagina. The condition occurs when the bladder, vagina, uterus and other pelvic organs drop from their normal position. Vaginal mesh is also used to treat stress urinary incontinence, which is urine leakage, in women. The U.S. Food and Drug Administration (FDA) issued a warning in July 2011 about surgical mesh after receiving over 3,800 adverse events reports about the device from 2008 to 2010. In January, the FDA issued an order that reclassified surgical mesh used to repair pelvic organ prolapse through the vagina from a moderate-risk device to a high-risk device. The agency’s order does not apply to surgical mesh for stress urinary incontinence or abdominal repair of pelvic organ prolapse.

According to court documents, the trial that recently ended is the second one held in Philadelphia County’s Court of Common Pleas, where more than 170 mesh lawsuits against Ethicon are consolidated in the court’s mass tort program. In the first trial held in December, a woman who suffered complications from Ethicon’s Proflit implant was awarded $12.5 million in damages. In addition to cases pending in Philadelphia, Ethicon is facing 29,200 bladder mesh complaints in the U.S. District Court, Southern District of West Virginia. The lawsuits that allege mesh erosion, vaginal scarring, and perforation of the bowel, bladder and blood vessels, are consolidated in the federal court for pretrial proceedings.
