Xarelto Bleeding Lawsuits Allege The Blood Thinner Does Not Have An Approved Antidote To Stop Severe And Fatal Bleeding.

xarelto-bleeding-lawsuits-Wright-and-Schulte-LLCAs filings continue of Xarelto bleeding lawsuits alleging brain bleed, gastrointestinal bleed and other side-effects, the judge managing the federal Xarelto litigation established the criteria for selecting cases for bellwether trials. The Xarelto bleeding lawsuits pending in the U.S. District Court, Eastern District of Louisiana, accuse Bayer HealthCare and Janssen Pharmaceuticals Inc, the maker and marketer of the blood thinner, of failing to disclose Xarelto’s dangerous side effects that include blood clots, hemorrhaging, and uncontrolled bleeding which can lead to death.

In a Case Management Order issued on December 17th, U.S. District Judge Eldon Fallon said Xarelto lawsuits must satisfy criteria in six categories to be eligible as potential cases for trial. Three categories will include plaintiffs who took Xarelto to treat deep vein thrombosis and pulmonary embolism. The remaining categories will include plaintiffs who took Xarelto to reduce the risk of stroke and systemic embolism due to atrial fibrillation not caused by a heart valve problem. Plaintiffs must also allege suffering injuries that include:

• Gastrointestinal bleed
• Rectal bleed
• Nose bleed
• Brain bleed
• Hemorrhagic stroke
• Death

Although more than 2,800 Xarelto bleeding side-effects complaints are pending in the Louisiana court, only 40 lawsuits will be selected as potential cases for trial. According to the CMO, plaintiffs and defendants will chose 20 cases and the court will choose the remaining cases. (In Re: Xarelto Products Liability Litigation, No. 2592)
“With Judge Fallon establishing criteria for selecting potential cases for trial, jurors will be able to hear in detail about the life-threatening bleeding side effects that plaintiffs have suffered allegedly due to using Xarelto,” says Wright & Schulte LLC.

Xarelto (rivaroxaban) is a popular anticoagulant used to treat deep vein thrombosis, pulmonary embolism and atrial fibrillation not caused by a heart valve problem, and to reduce the risk of blood clots. Bayer touts Xarelto as being the number one blood thinner in its class with more than 13 million Xarelto prescriptions in the United States. Xarelto is a new-generation anticoagulant which is more convenient for patients because regular blood monitoring is not required as it is with warfarin (Coumadin, Jantoven), a competing blood thinner that has been on the market for over 60 years, according to the U.S. Food and Drug Administration (FDA). Warfarin uses vitamin K as an antidote should bleeding occur. Xarelto does not have an approved reversal agent to treat internal bleeding, according to the FDA.

The first federal trial for the Xarelto lawsuits has been scheduled for February 2017, followed by a second trial in March 2017. Bellwether cases are representative of a larger number of cases pending in litigation. Bellwether trials are considered “test trials” that help the parties predict the outcome of other cases scheduled for trial in the future. The Xarelto claims commonly allege that Bayer and Janssen knew or should have known that Xarelto has dangerous side effects, and further testing was needed on the bleeding risks before the blood thinner was put on the market.
