40 More IVC Filter Injury Lawsuits Allege Inferior Vena Cava Filters Cause Serious Injuries And Fail To Prevent Fatal Injury From Blood Clots.

IVC-Filter-Lawsuit-LawyerMore than 40 IVC filter injury lawsuits were added in the past month to multidistrict litigations pending against C.R. Bard Inc. and Cook Medical Inc. The combined total of Inferior Vena Cava or IVC filter lawsuits rose from 339 in February to 382, as of March 15. C.R. Bard and Cook Medical are defendants in IVC filter lawsuits that allege their IVC filters cause serious or fatal injuries when they fracture, tilt, migrate, and perforate the heart, lungs or inferior vena cava and fail to stop blood clots from reaching the lungs or heart.

The U.S. Judicial Panel on Multidistrict Litigation’s (JPML) MDL statistic report shows IVC filter lawsuit claims against Bard’s Recovery and G2 blood filters climbed from 84 as of February 16, to 93 as of March 15. The IVC filter injury lawsuits against Bard are centralized in the U.S. District Court, District of Arizona. (In Re: Bard IVC Filter Lawsuit Litigation – MDL No. 2641) The number of IVC filter lawsuits filed against Cook Medical over its Celect IVC and Günther Tulip IVC filters rose to 289 as of March 15, from 255 in February. The Cook IVC filters complaints are consolidated in the U.S. District Court, District of Southern Indiana. (In Re: Cook Medical, Inc., IVC Filters Marketing, Sales, Practices And Products Liability Litigation, MDL No. 2570)

“The number of IVC filter lawsuits are steadily rising which means patients with IVC implants are still suffering harm from the medical devices,” says Wright & Schulte LLC.

Retrievable Inferior Vena Cava (IVC) filters are small medical devices designed to capture blood clots with its struts or “legs” to prevent them from reaching the lungs and causing a pulmonary embolism. The filters are implanted in the inferior vena cava, a large vein that carries blood from the lower part of the body into the heart. IVC filters are used in patients who are at risk of developing a pulmonary embolism and cannot use blood thinners or blood thinners are ineffective.

IVC filters have come under scrutiny of the U.S. Food and Drug Administration (FDA) after the agency recorded 921 adverse events reports about IVC filters since 2005. The majority of reports, 328, involved the filters migrating from their original position, followed by 146 complaints over the components detaching from the device. Since 2010, the FDA has issued two public health alerts advising doctors to remove IVC filters as soon as the threat of a pulmonary embolism has subsided. IVC filters are intended for temporary use and serious complications can occur when they remain implanted longer than necessary.

Court records show the IVC complaints against Bard and Cook Medical accuse the companies of hiding the health risks associated with their devices. One IVC filter lawsuit filed in the Arizona District Court against Bard involves a Missouri woman who contends her Bard G2 IVC filter was defectively designed and failed after it fractured and caused her serious injury. The complaint purports that Bard did not perform adequate clinical testing to ensure that its medical device was safe and effective. (Case No. 2:16-cv-00687)
