3T Heater-Cooler Lawsuits Allege Heart Surgery Patients Are At Risk Of Life Threatening Infections After Exposure To Mycobacterium Chimaera Bacteria.

Researchers in Denmark investigated all heater cooler units in that country, according to a study published ahead of the March 2017 print edition of the Emerging Infectious Diseases journal. Researchers found M. chimaera in 18 of the 21 heater cooler units examined in all five thoracic surgery departments in Denmark. Of the four sites that used Sorin 3T Heater-Coolers, M. chimaera was found in 14 of the 16 units. The other site used Maquet Heater-Cooler units and four of the five units contained M. chimaera. Additionally, bacteria in Sorin 3T Heater-Cooler units in Denmark were nearly identical to bacteria found in the United States and the United Kingdom. 3T Heater-Cooler units are used to keep patients warm or cool during surgeries involving the heart, lung and chest. The units have water tanks that provide temperature-controlled water to external heat exchangers or warming-cooling blankets through closed circuits, according to the U.S. Food and Drug Administration (FDA). The FDA has issued warnings about Sorin 3T Heater-Cooler devices, with the most recent one in December advising health care facilities to immediately remove units and accessories that have tested positive for the M. chimaera bacteria. In October, the U.S. Centers for Disease Control and Prevention directed doctors and hospitals to alert open-heart surgery patients about the potential risk of NTM infections.

Court documents indicate that Sorin 3T Heater-Cooler lawsuits accuse LivaNova PLC of placing patients at risk for NTM infections. One heater-cooler lawsuit was recently filed on behalf of a South Dakota man who underwent an aortic valve replacement in June 2015. Due to deteriorating health, he underwent a second aortic valve replacement in November 2016, and surgeons discovered a massive infection of M.chimaera. The complaint says the plaintiff is critically ill and has developed several health complications including acute kidney injury that requires dialysis.
