3T Heater-Cooler Lawsuits Allege Cardiac Surgery Patients Developed Potentially Deadly Bacterial Infections Causing Serious Complications

The lawsuits were filed after patients developed serious bacterial infections after cardiac surgeries from the contaminated heater-coolers. The federally filed 3T Heater-Cooler lawsuits stated the 3T Heater-Cooler machines expose patients to Nontuberculous Mycobacteria (NTM) infections, namely M. chimaera. The life-threatening infections can cause fevers, joint and muscle pain, surgical wound infections, unexplained weight loss, extreme fatigue and other serious complications, including death, according to the complaints.

In an order issued on April 5, the JPML said that centralizing the 16 Sorin 3T Heater-Cooler lawsuits is not necessary since 10 of those complaints are proceeding in a “coordinated fashion” before a single judge in South Carolina. Of the remaining six cases, four were brought by the same plaintiffs’ counsel, “and the parties to those actions already are working successfully to minimize overlapping pretrial proceedings.” In addition to the District of South Carolina, 3T Heater-Cooler cases are also pending in Southern District of Iowa, Western District of North Carolina, Middle District of Pennsylvania and the District of South Dakota. Sorin 3T Heater-Cooler machines are used in open-chest surgeries to regulate a patient’s blood temperature. The machines have water tanks that provide temperature-controlled water to external heat exchangers or to warming-cooling blankets through closed units. Although the patient does not come in contact with the water in the tank, there is a potential for contaminated water to enter other parts of the unit or transmit airborne bacteria through the exhaust vent into the environment and to the patient.

Thousands of patients nationwide have been notified by medical facilities that they may have been exposed to M. chimaera, Mycobacterium abscessus, and other NTM bacteria during heart, lung and liver surgeries when a 3T Heater-Cooler unit was used. Consolidation of federal Sorin 3T Heater-Cooler lawsuits was requested by a plaintiff from South Carolina who alleges contracting M. abscessus after undergoing an aortic valve replacement and bypass grafting surgery in May 2014. The lawsuits states that the plaintiff’s condition began to deteriorate after the surgery. He was eventually diagnosed with an M. abscessus infection for which he is still being treated.
