The 3T Heater-Cooler complaints assert that contaminated heater-cooler units expose patients to Nontuberculous Mycobacteria (NTM) infections, namely M. chimaera. The potentially deadly infections are resistant to many antibiotics and cause patients to suffer joint and muscle pain, surgical wound infections, unexplained weight loss, extreme fatigue, and other serious complications, including death, according to the lawsuits.

The Pennsylvania man underwent heart valve replacement surgery in February 2015 at the Penn Presbyterian Medical Center and a Sorin 3T Heater-Cooler device was used, the complaint said. In August 2016, the man started feeling weak and lethargic and began losing weight. He was later diagnosed with an NTM infection and eventually had to have his mechanical heart valve removed and replaced. After the replacement surgery in December 2016, the original mechanical valve tested positive for NTM, the heater-cooler lawsuit states. The complaint asserts that LivaNova PLC and the medical center knew or should have known about the high infection risk the Sorin 3T Heater-Cooler device poses to patients. The lawsuit, filed in the Court of Common Pleas in Philadelphia, names Penn Presbyterian Medical Center as a co-defendant. Sorin 3T Heater-Cooler units are used in cardiothoracic and other surgeries to regulate a patient’s blood temperature. The units have water tanks that provide temperature-controlled water to external heat exchangers or to warming-cooling blankets through closed units. Patients do not come in contact with the water in the tank. However, contaminated water can enter other parts of the device and transmit bacteria through the air and through the unit’s exhaust vent into the environment and to the patient. In October 2015, the U.S. Food and Drug Administration (FDA) issued a Safety Communication that indicated a link between NTM infections and contaminated heater-cooler machines. The number of Sorin 3T Heater-Cooler lawsuits continue to mount in federal and state court nationwide.
