Vaginal Mesh Lawsuit Win For Woman Suffering Chronic Pelvic Pain, Urinary Tract Infections And Other Injuries From Ethicon’s Gynecare Prolift Product.

vaginal-Mesh-Lawsuits-Wright-and-Schulte-LLCJohnson & Johnson has suffered it’s fourth consecutive trial loss in vaginal mesh lawsuit. Where a jury has ordered $2.1 million to a Pennsylvania woman who suffered injuries after receiving the Prolift device made by the company’s subsidiary, Ethicon Inc. The Philadelphia Court of Common Pleas jury rendered its verdict on May 26, almost one month after another Pennsylvania jury ordered Johnson & Johnson to pay $20 million to a pelvic mesh plaintiff. Johnson & Johnson is still facing 180 transvaginal mesh lawsuits pending in the court’s mass tort program for pelvic mesh lawsuits.

The complaints allege that bladder mesh products made by Johnson & Johnson’s subsidiary, Ethicon Inc., are prone to erode and shrink and cause serious complications that include bleeding, chronic pelvic pain, vaginal scarring, urinary tract infections, and pain during sexual intercourse. Plaintiffs allege the pelvic mesh devices, used to treat stress urinary incontinence and pelvic organ prolapse in women, are defectively designed and Johnson & Johnson failed to warn of the risks associated with the medical devices.

In the most recent trial, the woman said in her complaint that she was implanted with Ethicon’s Gynecare Prolift mesh in 2006 to treat stress urinary incontinence and pelvic organ prolapse. According to the complaint, the Prolift device eroded into the woman’s vagina and bladder which caused her to suffer urinary tract infections, constant pelvic pain, pain during sexual intercourse and urinary incontinence. The pelvic mesh complaint accuses Ethicon and Johnson & Johnson of failing to warn of the risks associated with the Gynecare Prolift device. (Case No. 130603835, Philadelphia Court of Common Pleas, Philadelphia County, Pennsylvania)

The highest jury verdict of $20 million was awarded in Philadelphia in April to a woman who said she was left in constant pain due to her Ethicon Gynecare TVT-Secur vaginal mesh implant. In February 2016, the state court jury awarded $13.5 million to a woman who suffered complications from exposure of her Ethicon Prolift-TVT pelvic mesh sling. The jury trial in December 2015 ended in a $12.5 million verdict in favor of a woman who suffered complications from Ethicon’s Prolift implant.

“These four verdicts show that jurors believed the plaintiffs’ claims of experiencing life-altering injuries as a result of Ethicon’s pelvic mesh products,” says Richard W. Schulte, a founding partner of Wright & Schulte LLC, an experienced personal injury and mass torts law firm that currently represents numerous women in transvaginal mesh lawsuits.

The U.S. Food & Drug Administration (FDA) said it had received over 3,800 reports of serious complications stemming from transvaginal mesh devices. In 2016, the FDA reclassified mesh that treats pelvic organ prolapse from a class II, moderate risk device, to a class III, high risk device. Surgical mesh that treats stress urinary incontinence was not reclassified.
